By requesting a Consumer Report and/or Public Record Information (“Consumer Report Information”) from Check Your Tenants.com, LLC (“CheckYourTenants.com”), You agree that the information You provide is true and correct, and that:

  1. You are the person whose Consumer Report Information is being requested and,
  2. You are at least 18 years of age.

You understand that by accessing This Website, using This Website, or submitting an order You are providing “written instructions” to CheckYourTenants.com under the Fair Credit Reporting Act authorizing CheckYourTenants.com to obtain information Consumer Report Information of the requested person. You authorize CheckYourTenants.com to obtain such information solely for the purpose the authorized party accessing the Consumer Report Information to verify the identity and for Your personal review of the Consumer Report Information.

Under FCRA laws any person who knowingly and willfully obtains a Consumer Report Information under false pretenses (for example getting a Consumer Report Information on an individual without their permission), shall be fined under title 18, United States Code, imprisoned not more than 2 years, or both.

  1. If the Consumer has been rejected for credit, insurance or employment in the past sixty (60) days as a result of his or her Consumer Report Information, the Consumer is entitled to receive a disclosure of the nature and substance of all information in his or her Consumer Report Information directly from the consumer reporting agency free of charge;
  2. The FCRA permits Consumers to dispute inaccurate information in their credit file. Accurate information cannot be changed;
  3. The Consumer does not have to purchase the Services or other information or services from CheckYourTenants.com to dispute inaccurate information in the Consumer Report Information or to receive a copy of the Consumer’s credit report.
  4. To dispute information contained in the Consumer Report Information, the Consumer will contact the credit bureau(s) directly;
  5. Credit reporting agencies are required by law to give You a copy of Your credit record upon request, at no charge or for a nominal fee.

 

No Warranty

CHECKYOURTENANTS.COM AND THIS WEBSITE, INCLUDING ALL CONTENT, CONSUMER REPORT INFORMATION, PRODUCTS AND SERVICES MADE AVAILABLE ON OR ACCESSED THROUGH THIS WEBSITE, ARE PROVIDED TO YOU “AS IS”. YOU ACKNOWLEDGE AND AGREE THAT ALTHOUGH CHECKYOURTENANTS.COM NATIONWIDE CRIMINAL AND EVICTION REPORTS COVER A MAJORITY OF COUNTIES THROUGHOUT THE UNITED STATES, SOME COUNTIES, MUNICIPALITIES AND/OR GEOGRAPHIC AREAS MAY NOT BE COVERED IN THE REPORTS.

 

Refund Policy

CheckYourTenants.com reports are based on information obtained from a credit bureau, criminal and eviction data providers. CheckYourTenants.com makes no guarantees of the accuracy of the reports and therefore does not offer refunds when it comes to data believed to be inaccurate, incomplete or missing. This includes reports where a credit score was unable to be provided due to an applicant having insufficient credit data. Applicants should contact the credit bureau if they believe the information the bureau has on file is incorrect. Ultimate and Premium reports are available to the Landlord immediately after the applicant has initiated the release of his or her credit and criminal background information and therefore no refunds are provided under any circumstance.

Please note that it may take up to one (1) full business day under normal circumstances for cancellations to be finalized. If an applicant authorizes the release of their report before the cancellation has finalized, the party who provided payment will not qualify for a refund.

 

Report Accessibility

Reports are accessible by logging into Your account after the applicant has authorized the release of their report. Reports will remain viewable for 60 days. After 60 days reports will be removed and no longer be accessible.

The trademarks, service marks, and logos used in This Website are registered and unregistered trademarks. The trademarks belong to their respective owner including CheckYourTenants.com or Verify SSI. Each trademark owner has exclusive rights to the trademarks. Any unauthorized use of the trademarks is strictly prohibited. You may not display these trademarks without the specific authorization of the owner.

Force Majeure

CheckYourTenants.com shall be excused from delay in the performance of any obligations hereunder when such delay is the result of or attributable to acts of God, governmental authority, manufacturers delays or any other cause beyond their reasonable control.

 

Indemnification

Users agree to indemnify and hold CheckYourTenants.com harmless from and against any and all third party claims, demands, actions, losses, liabilities, costs and expenses (including reasonable attorney’s fees) arising out of or resulting from the User’s (or their affiliates) actions under this agreement.

 

Waiver

No waiver by any party hereto of any breach by the other party of any term, covenant or condition of this Agreement shall be deemed a waiver of any other breach (whether prior to or subsequent) of the same or any other term, covenant or condition of this or any other agreement.

 

Binding Effect

This Agreement, and all rights and obligations hereunder, shall be binding upon, and inure to the benefit of the parties hereto and their respective heirs, executors, administrators, personal representatives, successors, licensees and permitted assigns.

 

Paragraph Headings

Paragraph headings used herein are for convenience only, and shall not be deemed to be part of this Agreement.

 

Severability

If any provision in this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force without being impaired or invalidated in any way.

 

No Partnership

Nothing herein contained shall constitute a partnership between, or joint venture by, the parties hereto, or constitute either party an agent of the other. Neither party shall hold itself out contrary to the terms of this paragraph and neither party shall become liable by any representation, act or omission of the other contrary to the provisions hereof.

 

Entire Agreement

This Agreement represents the entire agreement between the parties hereto and supersedes all prior representations, negotiations, promises, understandings or agreements, whether oral or written, between the parties with respect to the subject matter hereof.

 

Amendments

No amendment or modification of this Agreement or of any covenant, condition, or limitation herein contained shall be valid unless in writing and made by the party to be charged therewith.

 

Remedies Cumulative

Except as may be expressly provided to the contrary herein, the parties’ various rights and remedies hereunder shall be cumulative and the exercise or enforcement of any one or more of them shall not preclude the enforcing party from exercising or enforcing any of the others or any right or remedy provided for by law.

 

Governing Law

This Agreement is entered into and shall be deemed wholly performed in Broward County, Florida and shall in all respects be governed by and construed in accordance exclusively with the laws of the State of Florida applicable to contracts made and to be entirely performed therein without regard to principles of conflicts of law. The parties specifically agree that the state or federal courts in Broward County, Florida, shall have jurisdiction and exclusive venue in respect of any and all disputes in connection herewith.
